SF in top 38 counties nationwide that deport "non-criminal aliens"


So much for San Francisco being a sanctuary city. The National Day Laborer Organization (NDLON) and two other organizations have unearthed statistics that show San Francisco in the nation’s "top 38" counties, when it comes to deporting immigrants who had not been convicted of crimes.

The statistics, which the U.S. Immigration and Customs Enforcement Department provided as part of a public records request,  also show that California is the top state in the nation, when it comes to deporting “non-criminal aliens,” which is how federal authorities categorize immigrants who lack visas and green cards, since both are simply violation of civil administrative law, and not criminal acts.

These revelations come as internal documents, procured by the New York Times, suggest that federal immigration officers, facing resistance from Chicago and Cook County to join ICE’s controversial Secure-Communities program, pushed local officials to secure the participation of reluctant police departments.

Immigrant advocates say these newly released documents are fueling concerns that S-Comm is being used to circumvent due process for immigrants, and futher illustrate the need for reform, at the statewide level, to avoid abuse.

But ICE refutes charges that it is circumventing due process and primarily deporting immigrants who have not committed serious crimes.
“Secure Communities is a comprehensive initiative to modernize the criminal alien enforcement process,” an ICE spokesperson told the Guardian. “While ICE prioritizes the removal of convicted criminal aliens, the agency still enforces the law with regard to other aliens who are subject to removal. In addition to criminal aliens, ICE’s priorities include other individuals who pose a potential threat to public safety - such as those with known gang affiliations and prior drunk driving arrests - as well as immigration fugitives and individuals who have tried to game the immigration system.”

ICE officials also said that their review of the latest S-Comm statistics for San Francisco County show that “more than 60 percent of the aliens who’ve come into ICE custody since Secure Communities’ local activation are convicted criminals. What’s more, nearly one third of those cases involve individuals who’ve been convicted of Level 1 offenses [felony crimes].

But NDLON spokesperson B. Loewe said the newest data show that, several years into the S-Comm program, problems that immigrant advocates have been raising since S-Comm began, are continuing.
“There is no protection for the innocent, or even victims of crime, and the program appears to lend itself to circumventing due process,” Loewe said. “The latest numbers should raise concerns for anyone who cares not just fro civil rights but also for public safety for all.”

The S-Comm statistics emerged as part of a Freedom of Information Act request that NDLON, the Center for Constitutional Rights, and the Immigration Justice Clinic of the Benjamin N. Cardozo School of Law filed pertaining to ICE’s controversial Secure -Communities program.

Launched in Texas in March 2008, S-Comm involves state and local entities in the enforcement of federal immigration law by turning on a mechanism to run fingerprints through various databases when individuals are arrested, even if those individuals are brought in on minor charges or if their charges are subsequently dismissed.

“What’s most significant is that San Francisco is among the top 38 counties nationwide, and among the top 13 California counties,” said Jon Rodney, communications project coordinator at the California Immigrant Policy Center.

“The numbers speak for themselves,” said Angela Chan, a San Francisco Police Commissioner and Asian Law Caucus staff attorney. Chan noted that between October 2008, when California began implementing S-Comm, and February 2011, California has deported 35,643 local residents.
“That’s 10,000 more than Texas, which deported 24,152 residents,” Chan observed. She also noted that California is the state that deports the highest numbers of residents nationwide.
The top 13 counties in California deporting the highest percentage of non-criminal?  Merced, Fresno, Tulare, Solano, Monterey, Kern, San Luis Obispo, San Francisco San Joaquin, Contra Costa, Riverside, Sonoma, and Alameda, in that order.

This latest round of charges comes ten months after S-Comm was first activated in San Francisco, and fresh on the heels of Assemblymember Tom Ammiano's announcement of AB 1081, a bill that would honor the right of local governments to opt out of the federal S-Comm and set basic safeguards for those municipalities that do decide to participate.

Chan notes that the Assembly’s Public Safety Committee will hold a hearing on AB 1081 on April 26.

“Ammiano’s bill is timely and crucial,” Chan said, noting  that California signed an S-Comm agreement without public input, notice or negotiations.

“That [process] raised concerns that California signed a boilerplate agreement that was dictated by ICE” Chan said. “And it’s part of the reason why we have such high numbers of deportations,” she continued, noting that Ammiano’s bill “connects to an existing clause,” in the memorandum of understanding  that the California Attorney General’s Office signed with ICE, back when Gov. Jerry Brown was still California Attorney General.

Ammiano’s bill would require the California Bureau of Criminal Identification and Information to modify the agreement it entered into with the US Department of Homeland Security in May 2009, regarding S-Communities. 

Meanwhile, in a March 7 memo (a copy was procured through NDLON’s public records request) ICE noted that its Secure-Comm program produced over 133,000 matches in the first five months of 2011, compared to 248,000 matches in 2010.

ICE also noted that since the program was first activated in Harris County, Texas, on Oct. 27, 2008, the agency has removed over 94,000 aliens and over 24,600 criminal aliens convicted of Level 1 (felony offenses) that were identified through the program.

“Deployment continues to be the primary driver for increased identifications,” ICE stated, observing that in the first five months of 2011, ICE will deploy S-Comm in 409 new jurisdictions. This means that by the end of May, 1,067 jurisdictions will be activated in 39 states, “covering 70 percent of the foreign non-citizen population.”

ICE’s goal is to deploy the program to an additional 488 jurisdictions by the end of 2011, bringing the total jurisdictions deployed by year’s end to 897.

But as Chan notes, Ammiano’s AB 1081 has implications for how and whether S-Comm gets activated in any more California counties,
“AB 1081 requires needed modifications to California’s S-Comm agreement, which was signed in April 2009 by California,” Chan said. “ It was one of the first, if not the first, agreement signed by a state to enter into S-Comm.  AB 1081 taps into this contract term, which allows modification and termination of the agreement, to allow counties to opt in or out of the deeply flawed program.”



There ARE no "non-criminal aliens". They are here ILLEGALLY. That means without the proper papers, through the proper procedures!

The good Dr. must check his facts. The Europeans that came here a century ago were screened for disease and employability. There was many unskilled jobs to absorb the newcomers nor was there any taxpayer funded welfare back then. The immigrants of today don't want to assimilate into the American culture but they embrace the failed culture that they left.

They take my money for services they are not entitled to, i.e. healthcare. Public services citizens have a right to. They're working illegally...cause they are HERE illegally. Therefore they pay no taxes, cause they don't have Social Security Numbers (or valid ones). Nor do they have proper identification.

So they put no money in for services, but sure as hell suck the system for all they can get, now don't they?

Medi-cal, Medic-aid, free hospital visits (hell, they just ignore the bill - and who pays for that? WE DO), etc., etc.

Let's talk about the real "criminal aliens" for a change. There were around 10 million Native Americans living in this country at the time Columbus arrived. Now, less than a million remain. If you've learned your history, you know that this occurred at the hands of white Europeans who subjected the native peoples to a systematic campaign of extermination through massacres, starvation, relocation, disease, etc.

"As the Congressional Research Service points out in a 2007 report, undocumented immigrants, who comprise nearly one-third of all immigrants in the country, are not eligible to receive public "welfare" benefits-EVER. Legal permanent residents (LPRs) must pay into the Social Security and Medicare systems for approximately 10 years before they are eligible to receive benefits when they retire. In most cases, LPRs cannot receive SSI, which is available only to U.S. citizens, and are not eligible for means-tested public benefits until 5 years after receiving their green cards.

"A 2007 analysis of welfare data by researchers at the Urban Institute reveals that less than 1 percent of households headed by undocumented immigrants receive cash assistance for needy families, compared to 5 percent of households headed by native-born U.S. citizens."


According to the Migration Policy Institute, "the labor-force participation of male undocumented immigrants is 94%, exceeding the rate of both native-born and work-authorized immigrant men." Moreover, a recent UCLA study reveals that legalizing undocumented immigrants would help the economy~

The Travesty of our Immigration laws

Have you seen the power of TEA PARTY, as currently the new politicians refuse to bow down to the Sen. Harry Reid's or majority speaker John Boehner who are willing to compromise over cutting $100 billion dollars from the US deficit. The Tea Party will not sanction this controversy issue and will stand their ground, in the same old "Business as Usual" diatribe, even if the the US Government has to close down. Republicans have been infiltrated by honest, sincere party members, including lawmakers who have deserted the old party corruption and greed. Currently The TEA PARTY is becoming a giant engine, as millions of delusional Americans are joining the membership. The Tea PARTY believes in Fiscal Responsibility, Limited Government,a Free Fair Market and a Strong National Security That requires each administration honor their oath of allegiance, to protect and defend America from enemies domestic and foreign. This is an ultimatum of the TEA PARTY to Secure tight our border, employ 5000 military personal fully armed and to halt the bleeding of our countries financial welfare resources by illegal aliens. None of these policies are being enforced, as billions of dollars are still being consumed by the education, medical care for foreigners who have illegally residing here. Join the party that will halt every parody of the "Rule of Law" that consumes the United States entitlement programs. How many of you taxpayers would like to know the costs, to subsidize the hundreds of thousands of families with birthright citizenship babies? Each year for 30 years or more? In my book its impossible to estimate the dollars that has subsidize the households of perhaps the first, second, third offspring, because of the misinterpretation of the 14th Amendment. With each babies collecting $600.00 dollars for every child, the amount adds up quickly. This is devastating when an US pensioner can only collect a little less than a thousand dollars. Cash payments in California is only the monthly subsidy, as they also receive food stamps, health and education benefits, along with low cost housing. Even this is not the limit, as if the child is born with a medical problem the annual payments fly upwards. This is why America must rescind or amend the absolutely ludicrous rip-off of taxpayers. Billions are being soaked into foreign nationals that shouldn't even be here. California is well known as a Sanctuary State, as Liberal Dominance is manifest in Sacramento.

For decades now the American taxpayers have been supporting illegal aliens without their knowledge or prior permission. Including this immigration invasion are six stealth amnesties. Its well documented that Billions of dollars have been swallowed up in welfare, while at least 45 billion dollars leave this country in wire transfers. It blatantly obvious that neither the Liberal-Democrats or the Republican intend to stop this parody of our laws. For the Lib-Democrats its more votes, for Republicans its discount labor. The TEA PARTY is the only true remedy to halt the illegal alien occupation, and would strengthen our laws. Underneath this camouflage of both parties is a kind of shadow government. Boost our economy? Do you have any idea how much municipal money is spent supporting these criminals? How many jobs they take? For the most part they don't pay taxes because they are ILLEGAL and do not have identification!

San Francisco General, for an example...how much do you think is spent every year on healthcare for these illegals and their broods? Bet it's in the 7 figure range. Ditto for other city services, and let's not even consider State or Federal services.

They want to live here, let them do it legally. Use the procedures that are in place. Get a fucking green card. Become a citizen. I am so very tired of watching the burgeoning tide of illegals in this town and the bleeding heart liberals who wring their hands and cry when these vultures are caught and sent back to where they came from. You love em so much, go WITH them. Help them through the process from THEIR end. We won't miss you.

Marc is right. Undocumented immigrants are younger and healthier than their native-born counterparts. As a consequence, they contribute more to the economy than they take away in services. In fact, they are NOT eligible for federal services EVER.

Immigrants come here to work, not to get on welfare. According to the Migration Policy Institute, "the labor-force participation of male undocumented immigrants is 94%, exceeding the rate of both native-born and work-authorized immigrant men."

As per not paying taxes, well, on that one, you are only 100% wrong: Illegal immigrants pay social security payroll taxes but are not eligible for benefits. During 2006, Standard & Poor's analysts wrote: "Each year, for example, the U.S. Social Security Administration maintains roughly $6 billion to $7 billion of Social Security contributions in an "earnings suspense file" -- an account for W-2 tax forms that cannot be matched to the correct Social Security number. The vast majority of these numbers are attributable to undocumented workers who will never claim their benefits."

In fact, all you are is a standard issue hysteric.

Yeah, back that up, hombre. What's your source for those "millions per annum"? Show me some stats. And pay attention, Paul...where did I say that immigrants don't pay taxes? In fact, the link I provided says just the opposite.

Now, San Francisco is fortunate to have a program called Healthy San Francisco which provides health care access for the uninsured, whether they are citizens, LPR's or undocumented immigrants. The program has led to a 27 percent decrease in hospital emergency department visits for all uninsured residents in the first year of the program~


Moreover, a UCLA study found that undocumented residents make up a small share of California’s uninsured population~

Hey Ken, at the rate that the corporate parties are running the US economy into the ground, pretty soon there will be no economic incentive for immigrants to come north anymore.

That means instead of having to whine about "illegals," you will begin to whine about a lower standard of living and widespread squalor, just like in much of post-NAFTA Mexico.

I'm sure that you'll find a way to blame the "libs" or "illegals and their brood" for your own ongoing stupidity in supporting corporate politics that ends up screwing us all.

Given the truckloads of public cash and subsidy that is being siphoned off to the über riches, I'd wager that any public funds that go to immigrants pales in comparison. I believe that the record shows that undocumented immigrants pay more in sales and payroll tax than they take in services because their status as undocumented makes taking services that they pay for risky, while the need by the economy for cheap labor is given a nod and a wink by the corporate parties.

Good news, glad to hear the Federal government is making an attempt to control this out of control problem.
It does not matter if the illegal alien is a felon or not. If the illegal alien gets arrested for whatever criminal offense, I am sure they are not outstanding individuals of good moral character to begin with.
This country cannot afford to pay for all the expenses incurred by illegal aliens especially the overcrowding of hard core felons in state prison not to mention gang members.
Keep of the good work Secure Communities Initiative, ever county in the U.S. should have it.

Sarah, thank you for this thoughtful, well-researched and lucidly written piece. This exposes the lie behind the S-Comm program. We were told that S-Comm would be used to identify and deport serious offenders. But according to the government's own statistics, "approximately 28% of people ICE has deported through S-Comm are non-criminals."

Like the 287(g) program, S-Comm has led to abuses like racial profiling and harassment of innocent people (mostly people of color). It instills fear in communities and makes it harder for the police to do their job (since witnesses are afraid to come forward). This is why Sheriff Hennessy and police organizations across this country have come out against S-Comm. It has no place in a sanctuary city like SF where it stands out as a contradiction of our values.

And yes, everyone is innocent until proven guilty in this country, but unfortunately we also have a history of vigilante justice, lynchings and virulent racism. We should take care not to repeat the injustices of this shameful past.

Immigrants want safe communities, but programs like S-Comm create a chilling effect on victims or witnesses to crimes coming forward, and that hurts us all. And when even victims of domestic violence are swept up, it's just so clear S-Comm is totally messed up.

Ignorant people, ignorant of the world's present state, ignorant of the history, ignorant of the origin and procedures that US has taken in order to secure its living standard. Ignorant of the manipulation of the system, ignorant of other cultures true and core values.

alien? alien form where? there's only one world. Then if you believe in borders, read history and then see who's the alien and since when and how did it happen.

You don't call yourself and alien when you go to Mexico and buy land and make businesses with their territory in a touristic destination, when the locals should have the right. But you come back and criticize them for their laziness, that you attribute to a slower pace of life and th fact of human contact and leisure time.

Remember that leisure time is something you don't enjoy that much, because capitalism has put so much pressure on you to the point that you do don't really care or have time to go and find out the true by yourself.

There should b more compassion and mutual respect, no culture is better than other, and if there's immigrants looking for job, there must be certain responsibility on your behalf.
I don't see you working in construction or other jobs that your stereotypes of a successful person wouldn't allow you to do, let alone your big ego.
